Terms of Service

The short version

We provide AI-powered business intelligence and marketing services through a subscription. You stay in control: our systems draft and propose, and nothing is published, sent, or spent on your behalf without your approval. Be honest with us, pay for what you use, and treat the service as the tool it is.

The service

• Tailwind Business Intelligence is a subscription service operated by LUXX ELEGANT LLC (Texas). It includes a private client portal, business analytics and research, drafted marketing content, AI phone and chat assistants, and strategy reports.
• Approve-first: actions that reach the outside world (posts, ads, emails, listings) are proposed to you and run only after your approval, unless you have explicitly turned on an automation for that action.
• We may connect to third-party platforms (for example Meta, Google, Stripe) only with your authorization, and only to deliver the service. You can disconnect any platform at any time.

Your account

• You must be authorized to act for the business you enroll, and the information you give us must be accurate.
• Keep your login private. You are responsible for activity under your account.
• You own your business data. We hold it to serve you, per our Privacy Policy.

Billing

• Subscriptions bill monthly through Stripe until canceled. Cancel any time; service runs through the period already paid.
• Fees for third-party platforms (for example your ad spend) are yours, run on your own accounts, and are separate from our subscription.

Honest limits

• Our analysis and drafts are decision support, not guarantees. Business outcomes depend on your market and your choices.
• We are not attorneys, accountants, or licensed financial advisors, and the service is not legal, tax, investment, or financial advice.
• The service is provided as-is. To the fullest extent allowed by law, our total liability is limited to the fees you paid us in the three months before the claim.

Fair use

• No unlawful use, no abuse of the systems, no attempts to breach security, and no reselling the service without a written agreement with us.
• We may suspend or end service for violation of these terms; you may cancel at any time.

Your contacts and consent

• You are responsible for having a lawful basis and any required consent to contact the people on your lists, and for honoring opt-outs and do-not-call requests. You will not use Tailwind to send messages you are not permitted to send.
• Our tools draft, and only where you turn on an automation, send on your behalf. You remain the sender of record.

Founding price, "$99 for your first year"

The founding rate of $99 a month applies for the first twelve months of a continuously active subscription, after which it moves to our standard price. It is personal to your account and not transferable. A cancellation or a lapse in payment ends it early, and reactivating later is at the then-current price. It does not cover taxes or third-party pass-through fees (for example your own ad spend). If we ever discontinue the service, the rate ends with it.

AI limits and your approval

• Our AI drafts, proposes, and can answer the phone. It is decision support, not a guarantee, and it can be wrong. Actions that reach the outside world run only after your approval, unless you have turned on a specific automation.

After termination

• You may export your data on request. After you cancel, we remove your business core and portal data from active systems per our Privacy Policy, keeping only what the law requires.

Changes and contact
