Terms of Service

Who we are

Tailwind Business Intelligence is a service of LUXX ELEGANT LLC, a Texas limited liability company ("Tailwind", "we"). These terms govern your use of tailwindbi.com and, together with your client agreement, the Tailwind service.

What the service is

Tailwind provides business intelligence and strategy tools: research about your business and market, a Business Score, a private strategist portal, and related deliverables. The service uses artificial intelligence and human judgment together.

What the service is not

Tailwind provides business information and strategy suggestions, not legal, tax, accounting, investment, or other licensed professional advice. Decisions about your business are yours. We work hard to be accurate, but we do not guarantee outcomes, revenue, rankings, or results.

Beta status

The service is in an invitation beta. Features may change, break, or be withdrawn. We are building openly with founding clients, and beta pricing reflects that.

Your data and our engine

• Yours: everything you give us, and the deliverables we generate for your business (your Score reports, runbooks, briefs, notes, conversations). You can export them.
• Ours: the Tailwind engine itself: our software, prompts and personas, scoring methodologies, templates, and our knowledge base. Nothing in these terms transfers any of it to you.
• Your business core is private to you: never shared between clients, never sold.

Payment

Paid engagements are month to month unless your client agreement says otherwise. You can cancel anytime, effective at the end of the paid period. Fees paid are non-refundable except where your client agreement or the law says otherwise.

Acceptable use

Do not misuse the service: no unlawful use, no attempting to breach security, no reselling access, no using the service to harm others.

Liability

To the maximum extent permitted by law, the service is provided "as is", and LUXX ELEGANT LLC's total liability arising out of the service is limited to the greater of one hundred dollars ($100) or the amounts you paid us in the three months before the claim. Neither party is liable for indirect or consequential damages.

Communications and recording

By providing contact details you agree we may contact you about the service. Calls with us may be recorded and transcribed for quality and record keeping; where notice is required, you will hear or receive it.

Governing law

Texas law governs these terms. Venue is Tarrant County, Texas.

Changes

We may update these terms; material changes will be communicated to active clients. Continued use after changes means acceptance.
